Guirguis (Migration)

The Administrative Appeals Tribunal (AAT) considered the application of Mr. Guirguis for a Temporary Graduate visa (subclass 485). The dispute concerned whether Mr. Guirguis had met the English language proficiency requirement for the visa, as stipulated by IMMI 15/062. The AAT was tasked with reviewing the delegate's decision to refuse the visa application.

The primary legal issue before the Tribunal was whether Mr. Guirguis's score on the Pearson PTE Academic test satisfied the minimum score requirements mandated by the relevant legislative instrument for the subclass 485 visa. The Tribunal set aside the delegate's decision and remitted the matter to the delegate for reconsideration.
