circumstances. Counsel for the respondent argued that I should adopt the view that there is in effect a presumption that the setting aside of a decision should operate only from the date of

It was not necessary for the majority in that case, to consider this question. But it was necessary for it to be considered ln Wattmaster Alco Pty. Limited v. Button (Full Court, Fox, Sheppard

Burchett J also considered whether an order should be made for the Minister to refund the amounts of duty levied under the invalid decision. While the applicant sought such an order, the issue was not raised at first instance, and Burchett J found that the lack of evidence on this matter could not be remedied by the tender of further material at that stage. Burchett J decided to simply set aside the invalid decision, leaving it to the parties to work out the consequences or take any further action necessary. However, Burchett J reserved liberty to the applicant to apply for further relief within fourteen days' notice. Burchett J also found that the applicant was entitled to its costs of the application, including the costs of the argument as to the form of the orders.
