Griffin and Trueman

The case of *Griffin and Trueman* concerned parenting orders made by Hannam J in the Federal Circuit Court of Australia. The dispute involved the father and mother of three children, B, C, and D, born in 2004, 2005, and 2006 respectively. The court was required to determine the future living arrangements and time spent between the children and each parent, as well as to make orders regarding parental responsibility, communication, education, and the conduct of each parent.

The court's reasoning led to a significant alteration of previous orders. Hannam J discharged all prior orders concerning the children and vested sole parental responsibility in the father. The children were ordered to live with the father, with specific provisions for the mother to spend time with them during school terms, alternate weekends, and school holidays, with certain conditions and limitations. The court also made detailed orders concerning communication between the children and parents, their schooling, geographical location, and prohibitions against physical discipline, drug and alcohol use, and denigration of the other parent.

Further orders mandated that each parent continue to attend psychological counselling to address issues including the impact of family violence, substance misuse, the effects of denigration, and the development of effective parenting strategies. The mother was also ordered to complete a Parenting After Separation course. Injunctions were granted restraining both parents from attending the other's residence without agreement, and specifically restraining the mother from allowing the children contact with a named individual. The father was also restrained from driving unless validly licensed. All outstanding applications were dismissed.
