CaseChat Overview and Summary
The primary legal issues before the Commission involved whether the agreement complied with the statutory requirements set out in the Fair Work Act 2009, including provisions on the procedural fairness of the agreement-making process and its substantive fairness. Specifically, the Commission had to consider whether the agreement was made in good faith and whether it provided for fair and reasonable terms and conditions of employment. The Commission also needed to ensure that the agreement met the requirements for coverage, notice, and bargaining representation.
In examining the application, the Commission assessed the evidence and submissions provided by both the employer and the employees' representative. The Commission found that the agreement was made in good faith and provided for fair and reasonable terms and conditions of employment. The Commission also determined that the agreement met the statutory requirements for coverage, notice, and bargaining representation. Therefore, the Commission approved the enterprise agreement, recognising it as a valid and binding instrument between the employer and the employees.
