CaseChat Overview and Summary

The parties involved in this matter were Graphic Packaging International Australia Converting Limited and its employees, represented by the Australian Manufacturing Workers' Union. The dispute centred around the proposed workplace agreement for the Regents Park facility, which the union opposed on the basis that it did not adequately protect employee rights and entitlements. The matter was heard in the Fair Work Commission, the body responsible for regulating workplace relations in Australia.

The primary legal issue the Commission had to resolve was whether the proposed agreement met the requirements of Australian workplace law, specifically under the Fair Work Act 2009. This included assessing whether the agreement provided for fair terms and conditions, and whether it was made in good faith and without coercion. The Commission also needed to determine if the agreement provided sufficient protections for employees' rights and entitlements, and whether it complied with any relevant industrial instruments.

In its decision, the Fair Work Commission examined the proposed agreement in detail, considering the submissions from both parties. The Commission found that the agreement provided for terms and conditions that were fair and reasonable, and that it had been made in good faith. The Commission also concluded that the agreement provided adequate protections for employees' rights and entitlements, and that it did not contravene any relevant industrial instruments. Based on these findings, the Commission approved the application for the agreement, determining that it met the necessary legal criteria.

As a result of the Commission's decision, the Graphic Packaging International Australia Converting Limited (Regents Park) Workplace Agreement 2025 was approved and will now govern the terms and conditions of employment at the Regents Park facility. The employees will now be bound by the terms of the agreement, and any disputes arising from its implementation will be subject to the jurisdiction of the Fair Work Commission.
