CaseChat Overview and Summary

In the Family Court of Australia, Ms Grange (the Applicant Wife) sought property orders against Mr Grange (the First Respondent Husband). The dispute concerned the beneficial ownership of two assets: a property transferred by the Husband to his daughter, Ms A (the Second Respondent), and the proceeds from the sale of certain allocations, which the Wife contended were held by the Husband's mother, Ms B (the Third Respondent), on trust for the parties. The Wife sought to join Ms A and Ms B to the proceedings and to obtain injunctions restraining dealings with these assets.

The primary legal issues before the Court were whether Ms A and Ms B should be joined as parties to the proceedings, and whether injunctions should be granted to restrain them, and the First Respondent, from dealing with the property and the sale proceeds, respectively. The Court also considered the Husband's assertion that the joinder of Ms A and Ms B was unnecessary, as he claimed they were beneficially entitled to the respective properties.

Justice Kent found that there was a serious question to be tried regarding the beneficial ownership of both the C Street property and the allocation proceeds. The Court was satisfied, based on the Wife's material, that Ms A appeared to be evading service, and that both Ms A and Ms B ought to be joined as parties. Given the Wife's case and the serious issues to be tried, the balance of convenience favoured granting the injunctions sought to preserve the respective properties pending trial. The Court also ordered the First Respondent to provide disclosure regarding the proceeds of the allocation rights.

The Court ordered that Ms A be joined as the Second Respondent and Ms B as the Third Respondent. Injunctions were issued restraining Ms A from dealing with the C Street property and Ms B from disbursing the proceeds of the E Allocations. The First Respondent was also restrained from dealing with the machines and assets owned by "F Contractors" and ordered to provide an affidavit detailing the proceeds of the E allocation rights. The Court reserved costs and ordered the Applicant and First Respondent to attend mediation.
