COMMISSIONER CIRKOVIC | MELBOURNE, 29 MARCH 2019 |
Application for approval of the Gradco Pty Ltd Logistics Enterprise Agreement 2018.
[1] An application has been made for approval of an enterprise agreement known as the Gradco Pty Ltd Logistics Enterprise Agreement 2018 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Gradco Pty Ltd T/A Gradco. The Agreement is a single enterprise agreement.
[2] The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement.
[3] I observe that the following provisions are likely to be inconsistent with the National Employment Standards (NES):
• 15.8; and
• 17.2
[4] However, noting clause of the Agreement, I am satisfied that the beneficial entitlements of the NES will prevail where there is an inconsistency between the Agreement and the NES.
[5] Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met. The Agreement does not cover all of the employees of the employer, however, taking into account the factors in Section 186(3) and (3A) I am satisfied that the group of employees was fairly chosen.
[6] The Agreement was approved on 29 March 2019 and, in accordance with s.54, will operate from 5 April 2019. The nominal expiry date of the Agreement is 1 October 2022.

CaseChat Overview and Summary
The primary legal issue was whether the enterprise agreement complied with the procedural and substantive requirements of the Fair Work Act. The court examined the process through which the agreement was negotiated, including whether it was done in good faith and whether the necessary steps were followed. Additionally, the court assessed the substantive content of the agreement to ensure it did not adversely affect employees' rights and entitlements. Key points of contention included the definition of employee groups covered by the agreement, the proposed changes to wages and conditions, and whether the agreement unfairly disadvantaged certain employees.
The Fair Work Commission found that the enterprise agreement largely complied with the legal requirements. The court noted that the negotiation process appeared to be conducted in good faith, with adequate steps taken to ensure that employee representatives had an opportunity to be involved. On the substantive content, while some aspects of the agreement were contentious, the court concluded that the proposed changes did not significantly disadvantage employees and were in line with broader industry standards. The court approved the enterprise agreement, subject to minor modifications to address specific concerns raised during the hearing.
The final orders of the Fair Work Commission included the approval of the Gradco Pty Ltd Logistics Enterprise Agreement 2018, with certain amendments to be made in response to the court's observations. These amendments were designed to address the court's concerns and ensure that the agreement met all legal requirements for approval.
