CaseChat Overview and Summary
The central legal issues before the Commission were whether the agreement was made in good faith, whether it provided for the lawful terms of employment, and whether it was fair and reasonable. The Commission also considered whether the agreement provided for the proper application of the National Employment Standards and other conditions of employment. The applicant argued that the agreement was a genuine attempt to reach an agreement that would be acceptable to both parties, and that it met the requirements of the Act.
The Fair Work Commission found that the agreement was made in good faith and provided for the lawful, fair and reasonable terms of employment. The Commission also found that the agreement provided for the proper application of the National Employment Standards and other conditions of employment. The Commission approved the agreement, noting that it contained provisions that were fair and reasonable, and that it met the requirements of the Act. The Commission also noted that the agreement contained provisions that went beyond the minimum standards set out in the Act, and that this was a positive aspect of the agreement.
