CaseChat Overview and Summary
The legal issues at the heart of this case included whether the proposed agreement provided for minimum entitlements that were no less favourable than the relevant national system award or registered agreement, and whether the agreement complied with the good faith bargaining requirements. Additionally, the Commission needed to assess if the terms of the agreement were fair and reasonable, taking into account the overall balance of the agreement and the interests of both employers and employees.
The Fair Work Commission carefully reviewed the proposed agreement, examining its provisions in light of the statutory requirements and the principles of good faith bargaining. The Commission determined that the agreement met the necessary criteria for approval. It was found to provide for no less favourable terms and conditions than the relevant award or agreement, and it was deemed to have been reached through genuine efforts at good faith bargaining. The terms of the agreement were considered fair and reasonable, taking into account the interests of both parties. Consequently, the Commission approved the Enterprise Agreement 2025 - 2029, thereby resolving the application in favour of GPPD Pty Ltd.
