GPFH and National Disability Insurance Agency

The Administrative Appeals Tribunal (AAT) considered an application by GPFH, represented by a third party, concerning a decision by the National Disability Insurance Agency. The core of the dispute revolved around GPFH's failure to attend three scheduled events before the Tribunal.

The Tribunal was required to determine whether GPFH had been given appropriate notice of the time and place of the Tribunal conference and two scheduled National Disability Insurance Scheme (NDIS) Determination of Hearing (NCTDH) sessions, as mandated by subsection 42A(7) of the *Administrative Appeals Tribunal Act 1975* (Cth). The Tribunal also had to consider whether to dismiss the application under subsection 42A(2) of the same Act.

The Tribunal was satisfied that GPFH and their representative had received adequate notification of the scheduled events. Having found that reasonable steps were taken by the Tribunal to contact the applicant and their representative, and in light of the non-attendance at the three scheduled events, the Tribunal dismissed the application filed on 21 September 2021.
