In the matter of *Gowda & Malik*, Judge Morley of the Federal Circuit Court of Australia considered a property settlement dispute between a husband and wife who were separated under the same roof. The core of the dispute involved the division of various assets and liabilities accumulated during the marriage.

The court was required to determine how to equitably divide the parties' property and superannuation interests, taking into account their respective contributions and financial positions. A key issue was whether any adjustment to the property division was warranted based on the parties' contributions, and how the husband's superannuation should be treated.

Judge Morley reasoned that while the husband's contributions favoured the wife by five per cent, no further adjustment to the property division was necessary. The court ordered that specific assets, including company shareholdings, real property, bank accounts, and a motor vehicle, be vested solely in either the husband or the wife. The husband was also made solely liable for a specific loan. The matrimonial home was to be sold, with the proceeds, after sale costs, to be divided such that the husband received 55 per cent and the wife 45 per cent, reflecting their respective net matrimonial asset positions prior to this division. Furthermore, the court ordered an equal division of the husband's superannuation, with a splittable payment of $62,664 to be paid to the wife from the husband's superannuation interest. The court also made orders for the division of household contents and appointed registrars to execute documents if either party failed to do so.
