The Administrative Appeals Tribunal considered an application for a Subclass 189 Skilled Independent visa. The applicant sought review of a decision concerning their eligibility for the visa.

The primary legal issue before the Tribunal was whether the applicant met the criteria for the Subclass 189 visa, specifically in relation to the provision of tax documents as evidence.

The Tribunal was satisfied that the applicant met the relevant criterion after receiving a copy of their notice of assessment for the year ending 30 June 2017. In light of this new evidence, the Tribunal concluded that the matter should be remitted for reconsideration. The Tribunal remitted the application for reconsideration with a direction that the applicant meets the criteria specified in cl.189.232(1) of Schedule 2 to the Regulations.
