Gould and Gould

In the matter of *Gould and Gould*, heard before Justice Cronin, the wife sought leave to file an affidavit containing a report from Mr L concerning a business in which the husband held an interest, and to adduce this evidence. The husband had an interest in this business.

The primary legal issue before the court was whether the wife should be granted leave to file the affidavit and report, and consequently, whether that evidence should be admitted. The court also considered the wife's application filed on 20 December 2007, and the listing of all matters pending the completion of a report by Mr P.

Justice Cronin granted the wife leave to file the affidavit and report from Mr L, permitting her to call this evidence if she chose. However, the wife's application filed on 20 December 2007 was otherwise dismissed. The court also granted leave for parties to approach the Associate to Justice Cronin to arrange a further mention regarding the listing of all matters once Mr P's report was finalised. The costs of the day for both parties and the Independent Children’s Lawyer were reserved.
