Gong and Wei

In the matter of Gong and Wei, heard before Watts J, the dispute concerned financial orders sought by the Applicant Wife against the Respondent Husband. The orders sought, as detailed in the "Wife’s Minute of Orders Sought" (Exhibit 1), related to the payment of specific sums to the Office of State Revenue and St George Bank, the management of rental income and mortgage payments for several properties, and restrictions on the Husband's ability to deal with his assets.

The court was required to determine the terms of the final financial orders to be made between the parties. Specifically, the court had to consider the amounts to be paid by the Husband, the ongoing arrangements for property expenses, and the nature of any restraints to be placed on the Husband's assets to secure compliance with the orders.

Watts J made orders substantially in accordance with the Wife's minute. The Husband was ordered to pay $49,342.52 to the Office of State Revenue and $35,532.72 to St George Bank. Further, the Husband was directed to pay the difference between rents received and mortgage payments for specified properties, along with any associated rates or levies, until further order. The Husband was also restrained from transferring, mortgaging, encumbering, or disposing of any interest in his property, except for payments of cash to meet the aforementioned obligations and his living expenses, without the Wife's prior written consent. Finally, the Husband was ordered to pay the Wife's costs of and incidental to the proceedings.
