As Mr. Gonawala failed to meet this essential criterion for the Direct Entry stream, and no claims were made for other visa streams, the Tribunal found that the primary criteria for the visa were not met. This also meant that the second and third applicants could not satisfy clause 187.311, which requires them to be a member of the family unit of a person who holds a Subclass 187 visa granted on the basis of satisfying the primary criteria.

The Tribunal affirmed the decisions not to grant the applicants Regional Employer Nomination (Permanent) (Class RN) visas.
