Golakiya (Migration)

The Administrative Appeals Tribunal considered an application by Mr. Golakiya concerning a Subclass 600 (Visitor) visa. The dispute centred on whether Mr. Golakiya met the character requirements for the visa, specifically in relation to providing a statement from an appropriate authority, which in this instance was a Police Clearance Certificate from the Government of India.

The primary legal issue before the Tribunal was whether the applicant satisfied the character test as prescribed by the relevant migration regulations. This involved determining if the provided documentation, or lack thereof, was sufficient to meet the criteria for the visa.

Consequently, the Tribunal remitted the application for reconsideration with a direction that the applicant meets the criteria under clause 600.213(1) of Schedule 2 to the Migration Regulations 1994 (Cth).
