GMZK and Child Support Registrar (Child support second review)

This matter concerned a second review of a child support assessment, brought by GMZK against the Child Support Registrar. The dispute centred on the percentage of care attributed to GMZK and another party, MDSY, in relation to a child identified as Child A. The review was conducted by Dr L Bygrave, a Member of the relevant tribunal.

The primary legal issue before the tribunal was whether the existing percentages of care previously determined for Child A remained appropriate, particularly in light of a new family assistance care determination. The tribunal was required to consider if any changes to the care arrangements warranted an alteration of the established care percentages.

Dr Bygrave reasoned that the existing percentages of care attributed to GMZK and MDSY accurately reflected the current family assistance care determination. Consequently, the Member was satisfied that there was no justification to alter the care percentages that had been in effect for Child A since 16 October 2014.

The decision under review was therefore affirmed.
