CaseChat Overview and Summary
The legal issues before the Commission involved assessing the compliance of the proposed agreement with the statutory requirements for enterprise agreements. Key considerations included whether the agreement provided for fair and reasonable terms and conditions, did not negatively affect employees' general rights and protections under the Fair Work Act, and had been genuinely agreed upon by both parties. Additionally, the Commission had to examine whether the agreement appropriately balanced the interests of both the employer and the employees.
In its reasoning, the Commission found that the proposed agreement did meet the necessary standards and provisions outlined under the Fair Work Act. It determined that the agreement provided for fair and reasonable terms and conditions, did not negatively affect employees' general rights and protections, and had been genuinely agreed upon by both parties. Furthermore, the Commission concluded that the agreement appropriately balanced the interests of both the employer and the employees. As a result, the Commission approved the GMB Electrics Pty Ltd Enterprise Agreement 2017 - 2021, making it a legally binding instrument.
The Fair Work Commission approved the GMB Electrics Pty Ltd Enterprise Agreement 2017 - 2021, effective from 1st July 2017 for a period of four years. The agreement now governs the terms and conditions of employment for the union's members, as long as it remains in force and does not contravene any applicable laws or regulations.
