Application for approval of the Global Diagnostics (Australia) Pty Ltd Sonographers Enterprise Agreement 2015.
[1] An application has been made for approval of an enterprise agreement known as the Global Diagnostics (Australia) Pty Ltd Sonographers Enterprise Agreement 2015 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Global Diagnostics Australia Pty Ltd T/A Global Diagnostics Australia. The agreement is a single-enterprise agreement.
[2] I am satisfied that each of the requirements of ss.186, 187 and 188 as are relevant to this application for approval have been met.
[3] The Health Services Union of Australia (HSU) being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) of the Act I note that the Agreement covers the organisation.
[4] I note that the application for approval was accompanied by 2 ‘conditional termination’ instruments made pursuant to subitem 18(3) of Schedule 3 to the Fair Work (Transitional Provisions and Consequential Amendments) Act 2009 (TPCA Act). In accordance with subitem 18(8), the 2 transitional instruments terminate when the Agreement comes into operation if the requirements of subitems 18(2) to (5) of Schedule 3 to the TPCA Act have been complied with. There is nothing in the material before me to indicate that those requirements have not been met.
[5] The Agreement was approved in Chambers on 26 March 2015 and, in accordance with s.54 of the Act, will operate from 2 April 2015. The nominal expiry date of the Agreement is 1 April 2018.
