Gawas (Migration)

The Administrative Appeals Tribunal (AAT) considered an application for review of a decision made by the Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs concerning a Subclass 485 (Temporary Graduate) visa. The applicant, Mr Gawas, sought to have the decision set aside and remitted for reconsideration.

The primary legal issue before the Tribunal was whether Mr Gawas met the health criteria prescribed by IMMI 15/144, which was relevant to his visa application. This involved assessing the findings of a medical examination undertaken by Mr Gawas and determining if those findings satisfied the requirements of the relevant legislative instrument.

The Tribunal found that the medical assessment provided by Mr Gawas did not adequately address all the requirements of IMMI 15/144. Specifically, the medical practitioner's report did not sufficiently detail the applicant's medical history or provide a clear assessment of his current health status in relation to the visa criteria. Consequently, the Tribunal determined that it could not be satisfied that Mr Gawas met the health requirements for the visa. The Tribunal therefore remitted the matter to the Department of Home Affairs for further assessment.
