Gaudi and Knowles

In the matter of *Gaudi and Knowles*, heard before Brown J, the dispute concerned applications made by the husband and wife. The husband filed a Form 2 on 11 October 2007, and the wife filed a Form 2A on 15 October 2007.

The court was required to determine the disposition of funds held in trust by the wife's solicitors and to consider the dismissal of the applications filed by both parties.

Brown J ordered that $10,000 be disbursed from the trust funds to each party, with the characterisation of these sums to be determined by the trial judge. The sum due to the husband is to be held in trust by his solicitor and disbursed only for counsel fees for the trial of outstanding applications, unless otherwise ordered. The applications filed by the husband and wife were otherwise dismissed. All costs of the day were reserved, and the reasons for judgment were to be transcribed and made available to the parties. The court also noted that the matter reasonably required the attendance of counsel pursuant to Rule 19.50 of the Family Law Rules 2004.
