In the Family Court of Australia, Benjamin J presided over proceedings involving the parties, Gardener and Rollings, concerning the welfare of a child, B. The dispute centred on interim parenting orders.

The court was required to determine the living arrangements for the child, B, and the extent of contact permissible between the child and the father. Additionally, the court considered the appropriate dissemination of information regarding a Children and Parent’s Issue Assessment and the implications of contravening any orders made.

Benjamin J ordered that, until further order, the child B would live with the mother and the father was restrained from approaching, contacting, or communicating with the child. Both parents were also restrained from discussing the contents of a specific report with the child. The court further directed that the Independent Children’s Lawyer provide a copy of the Children and Parent’s Issue Assessment to the respondent father and inform him of the adjourned hearing date. Pursuant to relevant sections of the Family Law Act, the court attached a Fact Sheet detailing the obligations and consequences of contravening the orders. The case management hearing was adjourned to 18 December 2012.
