Garant and Garant

In the matter of *Garant and Garant*, heard by Judge Phipps, the dispute concerned parenting orders for two children, X and Y. The court was required to determine the living arrangements for the children and the terms of their time with and communication with each parent.

The court was tasked with determining the primary residence of the children and the specific arrangements for their time with the non-resident parent, as well as the consequences of contravening any such orders. The court also considered the discharge of previous orders made on 21 May 2013.

Judge Phipps ordered that the children X and Y live with the husband. The wife was granted specific time with the children, including alternate weekends, mid-week visits, and a portion of school holidays, commencing from late May 2013. The children were also permitted to spend time with and communicate with the wife by telephone or electronic means according to their wishes, and otherwise as agreed. The court also noted that the matter was listed for mention on 8 August 2013 and included particulars of obligations and consequences of contravention pursuant to sections 65DA(2) and 62 of the *Family Law Act 1975* (Cth).
