The court further found that the Applicant had not acted to his detriment in a way that could be considered a legal detriment, such as by giving up a legal right or incurring a legal obligation. Therefore, the Applicant's claim for the return of the bond money was dismissed.

The court ordered that the Applicant was in breach of the Lease on 3 August 2010, that the bond money is not to be returned to the Applicant but forfeited by the Respondent, and that the parties are to pay their own costs of the proceedings.
