Gallard and Gallard

In the matter of *Gallard and Gallard*, heard by Bennett J, the paternal grandparents sought to make oral applications for orders by consent in terms of Exhibit “A”. The wife and the paternal grandparents were the parties involved in this application before the court.

The primary legal issue before the court was whether to grant the oral application for consent orders as presented. The court was required to determine the appropriate course of action regarding the proposed consent orders.

Bennett J dismissed the oral application for orders in the terms of Exhibit “A”. However, the court granted liberty to the wife and/or the paternal grandparents to make a further oral application on a future date for orders in different terms, to be made by consent. The proceedings were adjourned administratively, with liberty granted for the solicitors for the paternal grandparents to arrange a later suitable date by contacting the Associate of the court.
