CaseChat Overview and Summary

The Administrative Appeals Tribunal considered the application of Mr. Galindo Toapanta for a Subclass 500 (Student) visa. The primary issue before the Tribunal was whether Mr. Toapanta was a genuine temporary entrant, as required by clause 500.212 of Schedule 2 to the Migration Regulations 1994.

The Tribunal was required to determine if Mr. Toapanta genuinely intended to stay in Australia temporarily and to comply with the conditions of the visa. In making this determination, the Tribunal was obliged to have regard to Direction No 69, which outlines specific factors to be considered when assessing the genuine temporary entrant criterion. These factors include the applicant's circumstances in their home country and in Australia, the value of the proposed course of study to their future, their immigration history, and any other relevant information.

The Tribunal noted that Mr. Toapanta had been in Australia since September 2019, had completed only one general English course of approximately nine months, and had not returned to Colombia during this period. He had also not studied while he was a dependent on his wife's student visa. However, the Tribunal also acknowledged that Mr. Toapanta had successfully completed his English course, had not enrolled in and abandoned multiple courses, and intended to complete his current course of study. The Tribunal found the factors for and against Mr. Toapanta being a genuine temporary entrant to be closely balanced.

Given the closely balanced nature of the evidence and the applicant's stated intention to return to Colombia upon completion of his current studies, the Tribunal concluded that the matter should be remitted for reconsideration. The Tribunal indicated that any future student visa application by Mr. Toapanta would be assessed in light of his previous evidence regarding his intention to stay in Australia temporarily for study.
