Gagudju Association v Northern Land Council

The Gagudju Association filed an application against the Northern Land Council seeking declaratory and injunctive relief in relation to the Council's authority to prosecute certain proceedings and the distribution of moneys pursuant to the Aboriginal Land Rights (Northern Territory) Act 1976 (Cth). The Northern Land Council filed a notice of motion seeking to have parts of the statement of claim struck out on various grounds including that it disclosed no reasonable cause of action. The court was required to decide whether it had jurisdiction to hear the matter, whether the application for review under the Administrative Decisions (Judicial Review) Act 1977 was made within time, and whether the applicant had standing to seek the relief claimed. The court also needed to determine whether the Northern Land Council's conduct in continuing to prosecute certain proceedings amounted to "action" within the meaning of the Aboriginal Land Rights (Northern Territory) Act 1976 (Cth) and whether the Council was required to be satisfied that certain requirements had been met before taking such action. The court held that it did have jurisdiction to hear the matter and that the applicant had standing to seek the relief claimed. However, the court found that the Northern Land Council's conduct in continuing to prosecute the proceedings did not amount to "action" within the meaning of the Act and that the Council was not required to be satisfied that certain requirements had been met before taking such action. The court therefore dismissed the claims to relief sought in paragraphs 1, 2 and 4 of the application and struck out parts of the statement of claim. The matter was adjourned for further consideration.
