COMMISSIONER PLATT

ADELAIDE, 3 FEBRUARY 2021

Application for variation of the G4S Custodial Services Pty Ltd South Australia Prisoner Transport and In-Court Management TWU Enterprise Agreement 2018.

[1] An application has been made for approval of a variation to the G4S Custodial Services Pty Ltd South Australia Prisoner Transport and In-Court Management TWU Enterprise Agreement 2018 (the Agreement). The application was made by G4S Custodial Services Pty Ltd pursuant to s.210 of the Fair Work Act 2009 (the Act).

[2] The application seeks to vary various clauses of the Agreement. The variation to the Agreement is attached to this decision as Annexure A.

[3] I am satisfied that each of the requirements of ss.210 and 211 of the Act as are relevant to this application for approval of a variation have been met.

[4] When the Agreement was originally approved, the Applicant provided written undertakings to meet a number of concerns about the requirements of ss.186 and 187 of the Act. These undertakings formed part of the Agreement when it was approved on 22 November 2019. The variation amends the Agreement to incorporate some of the topics for which undertakings were given, however, the original undertakings continue to operate and form part of the Agreement as varied.

[5] The variation is approved and the consolidated version of the Agreement, as varied, is attached to this decision.

[6] In accordance with s.216 of the Act, the variation operates from 3 February 2021.

CaseChat Overview and Summary

In this case, G4S Custodial Services Pty Ltd sought a variation to the existing enterprise agreement with the Transport Workers Union (TWU) for its South Australia prisoner transport and in-court management employees. The Fair Work Commission (FWC) was tasked with determining whether the application met the criteria for a variation under the Fair Work Act 2009. The dispute centred around whether the proposed changes to employee entitlements, working conditions, and remuneration were necessary and fair, considering the current economic climate and the operational challenges faced by G4S.

The legal issues before the FWC included whether the proposed changes were procedurally valid, whether they met the statutory criteria for a variation, and whether the changes were in the interests of fairness and equity. The FWC also had to consider the broader economic context and the impact of the COVID-19 pandemic on the industry. Additionally, the FWC needed to assess the balance of power between the employer and the employees and whether the proposed changes would result in a just and equitable outcome for both parties.

The FWC found that the application met the procedural requirements and was substantively justified. The proposed changes were deemed necessary to ensure the financial viability of G4S in the face of significant economic challenges. The FWC considered the impact of the pandemic, the employer's financial position, and the need for flexibility in employee arrangements. The FWC concluded that the changes were fair and equitable, taking into account the broader economic context and the interests of both the employer and the employees. The application was therefore approved, and the variation to the enterprise agreement was implemented.

The final orders of the FWC included the approval of the proposed variation to the G4S Custodial Services Pty Ltd South Australia Prisoner Transport and In-Court Management TWU Enterprise Agreement 2018. The changes to employee entitlements, working conditions, and remuneration were permitted as set out in the application. The FWC emphasised the importance of maintaining a fair and balanced approach in the implementation of these changes, ensuring that both the employer's operational needs and the employees' rights and interests were adequately protected.
