CaseChat Overview and Summary

In the Fair Work Commission, G4S Custodial Services Pty Ltd applied for approval of a proposed workplace agreement with the Australian Services Union. The dispute centred on the terms of the Correctional Services Workplace Agreement 2021, which was intended to regulate employment conditions for staff at Port Phillip Prison. The Australian Services Union contested certain provisions of the agreement, arguing that they did not comply with the Fair Work Act 2009.

The legal issues before the Commission included whether the agreement met the criteria for approval under the Fair Work Act, specifically focusing on whether the agreement provided for fair and reasonable terms, and whether it was made in good faith. The Commission had to examine the fairness of the proposed terms and conditions, including remuneration, hours of work, and other employment conditions. Additionally, the Commission needed to determine if the agreement was negotiated in good faith and whether it was appropriately certified by an accredited independent certifier.

The Fair Work Commission found that the Correctional Services Workplace Agreement 2021 was fair and reasonable, and had been made in good faith. The Commission considered the evidence provided by both parties, including submissions on the economic and operational context of the agreement. It was concluded that the proposed terms were balanced and met the requirements of the Fair Work Act. The Commission approved the agreement, noting that it provided for reasonable terms and conditions of employment, and that the negotiation process was appropriate.

The final orders of the Fair Work Commission were that the Correctional Services Workplace Agreement 2021 be approved and registered under the Fair Work Act 2009. The agreement was to take effect from the date of the decision, and would apply to the employees covered by the agreement.
