Froth and Froth

In *Froth and Froth*, heard before Watts J, the dispute concerned the division of property following the breakdown of a marriage. Specifically, the wife sought an order for the husband to pay her an amount representing dividends he had received on shares that had been transferred to her pursuant to an earlier court order. The husband also sought an order for a payment from a Westpac offset account.

The court was required to determine whether the dividends received by the husband on shares subsequently transferred to the wife were to be accounted for and paid to the wife. Additionally, the court had to consider the appropriate disposition of funds held in a joint Westpac offset account.

Watts J reasoned that the dividends received by the husband on the shares after the date of the transfer order were rightfully the wife's property, as the shares themselves had been transferred to her. Therefore, the husband was ordered to pay the wife the sum of $2,800 on account of these dividends. Regarding the Westpac offset account, the court ordered that both parties take the necessary steps to facilitate a payment of $28,037.98 to the husband from that account.
