Francis (Trustee), in the matter of Fotios (Bankrupt) v Helios Corporation Pty Ltd (No 2)

In this case, the Court was asked to provide advice on the priorities of various claims to the assets of a trust held by receivers. The bankrupt, Fotios, and the trustee of the bankruptcy estate, Francis, sought advice on the priority of claims to the trust assets held by the receivers, Helios Corporation Pty Ltd. The Court was required to decide the competing priorities between the rights of recoupment and exoneration, and the appropriate treatment of future costs that exceed the limits already approved. The Court found that the rights of recoupment should trump the rights of exoneration. The Court also held that there may be costs of the administration that do not relate to matters of recoupment and exoneration, and those costs should not be afforded the same priority as the cost of the receivership. The Court concluded that the orders should reflect this position in respect of any future costs that exceed the limits that have already been approved. The Court vacated the previous orders and provided new orders setting out the priorities of the claims to the trust assets held by the receivers. The orders also approved additional remuneration and expenses for the experts and set limits on the costs, expenses, and remuneration of the receivers and administrators.
