Foster and Foster

In *Foster and Foster*, Young J of the Family Court of Australia considered questions relating to costs and the attendance of counsel in proceedings under section 79 of the *Family Law Act 1975* (Cth). The proceedings had been adjourned on the day of the hearing.

The primary legal issues before the court were the payment and quantum of the wife's costs arising from the adjournment, and whether the matter reasonably required the attendance of Senior Counsel for the husband and Counsel for the wife, pursuant to Rule 19.50 of the Family Law Rules.

His Honour reserved all questions concerning the payment and quantum of the wife's costs. In relation to the attendance of counsel, the court certified that the matter reasonably required the attendance of Senior Counsel for the husband and Counsel for the wife.
