CaseChat Overview and Summary
The legal issues before the Commission centred on whether the proposed agreement complied with the relevant provisions of the Fair Work Act 2009, specifically sections concerning the protection of vulnerable employees, the provisions of minimum terms and conditions, and the fairness of the agreement overall. The Commission was tasked with assessing whether the agreement ensured that the employees were treated fairly and that the terms did not undermine the existing protections afforded to employees under Australian labour law.
The Fair Work Commission found that the Fortec Australia Enterprise Agreement 2016 met the statutory requirements for approval. The Commission concluded that the agreement was fair and reasonable, providing adequate protections for the employees. It was determined that the agreement included provisions that safeguarded the interests of the employees and did not disadvantage them in any way. Consequently, the application for approval was granted, and the Fortec Australia Enterprise Agreement 2016 was approved as compliant with the Fair Work Act 2009.
