FOLSTON & FOLSTON

In the matter of *Folston & Folston*, the dispute before the District Court of New South Wales concerned the validity of the marriage between Mr Folston and Ms Folston, solemnized in March 1970.

The court was required to determine whether the marriage was valid and to make a declaration to that effect. This involved considering the statutory requirements for marriage registration in New South Wales.

His Honour Faulks DCJ, applying section 113 of the *Family Law Act 1975* (Cth), declared the marriage to be valid and duly solemnized. The court further directed the Registrar of the Registry of Births, Deaths and Marriages in New South Wales to note this declaration and the satisfaction of the statutory requirements under section 33 of the *Births, Deaths and Marriages Registration Act 1995* (NSW).
