The appeal was allowed, and the decision of the Tribunal was set aside. The court ordered that the parts of the case identified at paragraph [118] of these reasons were to be heard and decided again by the Tribunal as originally constituted, with leave being granted to the parties to adduce further evidence if they so wish. The remitted proceedings were set down for a case conference at 9.30 a.m. on 6 July 2009.
