The Tribunal found that Fitzroy Childcare Pty Ltd had satisfied all the general requirements of regulation 5.19(4), including the proper lodgement of the application, payment of fees and charges, and satisfactory compliance with employment laws. It also found that the nominator was actively and lawfully operating a business in Australia, fulfilling regulation 5.19(9)(a). The Tribunal distinguished the role of a Chef, responsible for preparing meals and snacks for children and staff, from that of a Cook, concluding that there was a genuine need for the nominated position within the context of an early learning centre's operations.

Consequently, the Tribunal set aside the original decision and substituted a decision approving the nomination.
