CaseChat Overview and Summary

Fitzmaurice brought proceedings against GM & JM Holland in the Queensland Civil and Administrative Tribunal (QCAT) seeking a termination order for the lease of a cabin at the Cooloola Cabins & Caravan Park. Both parties sought termination orders under the Manufactured Homes (Residential Parks) Act 2003 (Qld), relying on different grounds for the orders. QCAT granted a termination order in favour of GM & JM Holland, but Fitzmaurice appealed to the District Court. The primary issues were whether QCAT exercised its discretion to grant a termination order correctly, and if the reasons provided for the order and the date set for termination were adequate.

The District Court found that QCAT failed to exercise its discretion properly and gave inadequate reasons for the exercise of that discretion. The court held that QCAT did not consider the appropriate factors and did not make the necessary findings to support the termination order. Additionally, the court found that the reasons provided for the setting of the termination date were inadequate, as QCAT did not consider the relevant factors and made no findings on them. The court concluded that the termination order and the reasons given for it were clearly wrong, warranting interference by the appellate court.

The appeal was allowed, and the termination order made by QCAT was set aside. The matter was returned to QCAT for reconsideration with specific directions. The court directed QCAT to list the original proceedings for a directions hearing, to determine the application by GM & JM Holland to adduce further evidence, and to consider the status of the parties to the proceeding. The court also directed that the rehearing not be conducted as a hybrid hearing and that QCAT make any other directions it considered appropriate. The appeal against the costs order was also allowed.
