Fisher v Roads and Maritime Services

The applicant, Fisher, sought an extension of time to seek leave to appeal a decision of Harrison J, which had refused an application for judicial review. The judicial review concerned the revocation of Fisher's authority to operate a commercial bus service by Roads and Maritime Services (RMS), a decision that had previously been confirmed by the Administrative Decisions Tribunal after an extension of time for an internal appeal was refused. The application for an extension of time to seek leave to appeal was lodged approximately three months after the relevant judgment.

The primary legal issues before Beazley P and Basten JA were whether to grant an extension of time for the applicant to seek leave to appeal, and consequently, whether the proposed appeal had any merit or raised an issue of principle. The court was required to consider the applicant's failure to provide any explanation for the significant delay in lodging the application, the absence of prejudice to the respondent (RMS), and the respondent's contention that the appeal lacked merit.

The Court of Appeal refused the extension of time. Their Honours noted that there was no explanation for the three-month delay in seeking leave to appeal. While acknowledging that the respondent suffered no prejudice and that the appeal might not have been without merit, the Court emphasised the importance of adhering to time limits in legal proceedings. Without a satisfactory explanation for the delay, the Court was not persuaded to grant an extension of time, effectively preventing the applicant from pursuing the appeal.

Consequently, the Court ordered that the applicant be refused an extension of time within which to seek leave to appeal from the judgment of Harrison J. The applicant was also ordered to pay the costs of Roads and Maritime Services in the Court of Appeal.
