CaseChat Overview and Summary
The legal issues before the Commission included whether the agreement complied with the procedural requirements, whether it was fair and reasonable, and whether it adhered to the relevant legislative provisions. The Commission also considered the extent to which the agreement provided for genuine collective bargaining, and whether it was consistent with the objects of the Fair Work Act, such as promoting harmonious, productive and cooperative workplace relations.
After reviewing the submissions and evidence from both parties, the Commission determined that the agreement met the necessary criteria for approval. The Commission found that the agreement had been genuinely negotiated between the parties and was fair and reasonable. It concluded that the agreement provided for adequate protections for employees, including provisions for minimum wages, leave entitlements, and dispute resolution mechanisms. The Commission also found that the agreement was consistent with the objects of the Fair Work Act and did not contravene any relevant provisions of the Act. Accordingly, the Commission approved the application for approval of the First Super Union Collective Agreement 2021.
The Commission ordered that the agreement be registered and become a registered agreement under the Fair Work Act. The agreement will now apply to the employees of First Super Pty Ltd and will remain in force until it is terminated or replaced by a new agreement. The decision provides certainty for both the employer and employees, and ensures that the agreement will be subject to the oversight and enforcement mechanisms of the Fair Work Commission.
