CaseChat Overview and Summary
The Fair Work Commission had to determine if the agreement provided for fair and reasonable terms and conditions, considering the broader economic environment, and if it complied with the procedural requirements for approval as outlined in the Fair Work Act. Furthermore, the Commission had to assess whether the agreement adequately addressed the needs and interests of both the employees and the employer while ensuring it did not undermine the objectives of the Fair Work Act.
After careful consideration, the Commission found that the agreement provided fair and reasonable terms for the employees, taking into account the economic conditions and the interests of both parties. The Commission approved the agreement, noting that it adhered to the necessary procedural requirements and appropriately balanced the rights and obligations of the employer and employees. The agreement was deemed to meet the standards set out in the Fair Work Act, ensuring it provided for fair and reasonable terms and conditions of employment.
The Commission approved the Finley Regional Care, NSWNMA and HSU NSW Enterprise Agreement 2014 - 2017, making it a legally binding document. The agreement would govern the employment terms and conditions for nursing staff at Finley Regional Care for the specified period.
