Fevga and Caprini

In the matter of *Fevga and Caprini*, heard before Cronin J, the dispute concerned applications relating to a property. The applicant, Ms R Caprini, sought orders concerning the property, and Mr Fevga sought exclusive occupancy of the same property. Ms Y Caprini was subsequently added as a party to the proceedings.

The court was required to determine whether to grant exclusive occupancy of the property to Mr Fevga, and to clarify the specific orders sought by Ms R Caprini. The court also considered applications filed by other parties, which were largely dismissed.

Cronin J ordered that Ms Y Caprini be joined as a party and file a response to the initiating application. Ms R Caprini was directed to file an amended initiating application specifying the orders she sought. Mr Fevga was granted exclusive occupancy of the property on the condition that he pay all outstanding and future mortgage payments and outgoings. The application filed on 14 March 2012 was otherwise dismissed, with one paragraph struck out but with a right of reinstatement. The responses filed on 19 April 2012 and 20 April 2012 were also dismissed.
