Faraday & McKenzie

In *Faraday & McKenzie*, O'Ryan J of the Family Court of Australia was required to determine the quantum of costs to be paid by the Husband to the Wife following final orders made on 21 December 2007. The proceedings concerned the division of property and other ancillary matters arising from the dissolution of the marriage.

The primary legal issue before the court was the assessment of the Wife's costs incurred in the proceedings and subsequent costs proceedings. The court was tasked with determining the appropriate sum to be awarded to the Wife for her legal expenses.

O'Ryan J ordered that the Husband pay the Wife's costs of and incidental to the proceedings concluded by the final order of 21 December 2007, assessed at $3,000. Furthermore, the Husband was ordered to pay the Wife's costs of and incidental to the costs proceedings, assessed at $1,000. Both sums were to be paid by 4:00 pm on 16 October 2009.
