Fall and Fall

In the matter of *Fall and Fall*, Dawe J considered a dispute between parents concerning the future education of their child, C. The proceedings also involved ancillary matters relating to property settlement.

The primary legal issue before the court was to determine which educational institution C would attend following 2008, and to make consequential orders regarding enrolment and notification. The court also addressed the sale of a property located on J Street and adjourned further applications concerning other properties.

Dawe J made orders directing the parties to notify E College that C would not be attending after 2008. The court further ordered the parties to accept a scholarship offered to C by S College for the 2009 to 2011 school years and to enrol C at S College. In addition, the court provided for a mechanism to ascertain C's wishes regarding attendance at S College, with further orders to be made if C expressed a desire to attend S College. The court also made orders for the sale of the J Street property and adjourned other property-related applications.
