Falk and Falk

In *Falk and Falk*, the Family Court of Australia considered an application by the husband for interim property settlement and sole use and occupation of the matrimonial home. The wife held funds in banking institutions, and the husband sought an order for a portion of these funds to be paid to him, as well as exclusive possession of the property.

The primary legal issues before the court were whether to grant the husband interim property settlement from the wife's funds and whether to grant him sole use and occupation of the matrimonial home pending further orders. These determinations were to be made in the context of an ongoing family law dispute.

Rees J ordered that the husband be entitled to the sole use and occupation of the property at B Street, Suburb C. Furthermore, the wife was ordered to pay the husband the sum of $200,000 from funds held by her in banking institutions by way of interim property settlement. These orders were made pending further order of the court.
