Fair Work Ombudsman v Bishnu Laxmi Ganesha Trading Pty Ltd and Ors

In reaching this decision, the Court applied the principles of statutory interpretation to the Fair Work Act and relevant awards, and considered the evidence presented regarding the employment arrangements and payment practices. The Court noted the importance of compliance with minimum wage obligations and record-keeping requirements to ensure the integrity of the industrial relations system.

The Court ordered Bishnu Laxmi Ganesha Trading Pty Ltd to pay pecuniary penalties totalling $30,000, with Mr. Bishnu Prasad Sharma and Ms. Laxmi Devi Sharma each ordered to pay penalties of $6,000. Furthermore, the company was ordered to rectify the underpayments of wages to its employees, with the total amount to be determined and paid within a specified timeframe.
