Façade Designs International Pty Ltd v Yuanda Vic Pty Ltd

The applicant, Façade Designs International Pty Ltd, sought special leave to appeal to the High Court of Australia from a decision of the Court of Appeal of Victoria. The respondent, conversely, maintained that the definition of "claimed amount" in section 4, read with section 14(2), referred to the amount originally claimed in the payment claim, and that section 16(4)(a)(ii) clearly prohibited judgment if the claimed amount included any excluded amount, with no provision for severance or amendment to cure such a defect.
