Application for approval of the Exide Technologies NSW Warehouse Enterprise Agreement 2022.

Exide Technologies has made an application for the approval of the Exide Technologies NSW Warehouse Enterprise Agreement 2022 (the Agreement). The application was made under s.185 of the Fair Work Act 2009 (the Act). The Agreement is a single enterprise agreement.

I am satisfied that each of the requirements of ss.186, 187 and 188 as are relevant to this application for approval have been met.

The Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia (CEPU) was a bargaining representative for the Agreement and has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the CEPU.

The Agreement is approved and, in accordance with s.54 of the Act, will operate from 17 August 2022. The nominal expiry date of the Agreement is 30 June 2025.

It further directed the parties to return to the negotiating table to reach an agreement that meets the requirements of the Fair Work Act 2009 and provides employees with a fair and reasonable set of terms and conditions of employment.
