The court reasoned that the legislation was intended to protect consumers entering into credit arrangements, and this particular transaction, involving a corporate borrower and a guarantor who was not a consumer in the context of the legislation, did not fall within its protective ambit.

Consequently, the Court of Appeal found that the guarantee was valid and enforceable. The appeal was allowed, and the orders of the Supreme Court were set aside.
