CaseChat Overview and Summary

The case of Erceg v Erceg was heard in a Queensland court, where the applicant, Jovanka Erceg, sought an injunction to restrain the second defendant from evicting her from a residential property. The first defendant is Jovanka's daughter, and the second defendant is the daughter's carer and guardian. The applicant claims that the property is held on trust for her and her late husband, and seeks a declaration to that effect as well as an order requiring the transfer of the property to her. The second defendant issued a notice to vacate to the applicant, prompting the application for an injunction.

The primary legal issue before the court was whether there was a serious issue to be tried regarding the interpretation of the declaration of trust and the nature of the equitable interest held by the applicant. The applicant argued that the declaration of trust evidenced a bare trust in favour of her and her late husband, which imposed an obligation on the daughter to transfer the property upon request. The guardian, however, contended that the declaration of trust indicated a life interest for the daughter, postponing the applicant's interest until after the daughter's death.

The court found that the construction urged by the guardian was not the only viable arguable construction, as the second document, the "Declaration of Trust," contained no clauses that qualified the declaration that the daughter holds the property on trust for her parents. Furthermore, even if the declaration of trust were held not to detract from the meaning of the deed of trust, the two subsequent paragraphs in the deed of trust did not expressly qualify the declaration made in the first paragraph.

The court concluded that there was a triable issue as to the nature of the equitable interest held by the applicant, and that the balance of convenience lay in favour of the applicant. Therefore, the court granted the injunction, restraining the second defendant from taking any steps to evict the applicant from the property until the determination of the trial or further order.

The court's final orders were that the second defendant, by herself, her servants, or agents, is restrained from taking any steps to evict the plaintiff from the house and land at 4 Anne Street, Smithfield until the determination of the trial or further order. The court also granted liberty to apply on the giving of two business days notice in writing and reserved costs.
