CaseChat Overview and Summary
The legal issues before the Commission were whether the agreement contained all the mandatory terms prescribed by the Act and whether the agreement had been made in accordance with the procedural requirements of the Act. Specifically, the Commission had to consider whether the necessary majority of employees had been consulted about the agreement, and whether the agreement complied with the good faith bargaining requirements and other statutory provisions.
The Commission examined the evidence provided and found that the agreement contained all the mandatory terms as required by the Act. Furthermore, the Commission was satisfied that the agreement had been made in accordance with the procedural requirements of the Act, including that the requisite majority of employees had been consulted and that the agreement had been made in good faith. The Commission also noted that the agreement provided for appropriate mechanisms for the resolution of future disputes between the parties. Therefore, the Commission approved the application and certified the Preston ePharmacy Enterprise Agreement 2015 as a registered agreement. This decision ensures that the terms and conditions outlined in the agreement will be legally binding for the employees covered by it.
